Exempt assets could be a solution to decrease the countable value of assets and establish financial need
You must prove that you have financial need, regardless whether you're filing a claim under the Veterans Disability Act. You can show your financial need by decreasing your assets. In certain cases, exempt assets can be used to prove your need. However it is crucial to understand that the rules are not very clear.
For example, the VA will not subtract mortgages from countable assets. This can create problems for rural residents. Many of them have lots larger than two acres. They might be suitable for agriculture but they aren't practical for large numbers of residents.
Additionally, the VA does not count the income earned from annuities and similar financial instruments. In some cases such income might be sufficient to qualify for benefits. If you have to pay for a medical expense that is unusual then the VA will deduct this from your monthly income. The VA can also deduct these expenses from your monthly income.
Apart from calculating your countable assets in addition, the VA also determines the penalty period. The penalty period is calculated on the percentage of transferred assets. The penalty period cannot be recalculated if assets are transferred after the effective date. In some cases, it will be applied retroactively. If you transfer an annuity purchased prior to the date of the effective date, the penalty will be calculated based on the annuity's value. In other cases, the penalty period will be calculated based on the value of your transferred assets.
The proposed VA regulation does not explain how asset calculation works. Some commenters were skeptical of the VA's plan to use all information available. Others questioned the VA's decision to employ third-party researchers to study the value of properties. The VA did not change its policy due to feedback however, it clarified the exclusion of residential properties based on the value of the property.
The VA did not make any exceptions for burial policies. This could affect the claimant who has recently been involved in an accident.
VA's equity action plan recognizes the long-standing gender and race discrimination in benefits access.
The OMA has created its first equity plan based on data from 1,048 VA employees. This acknowledges that there are differences between race and gender in the way they access benefits and services. As part of its new plan that was released, the OMA has released a number of suggestions that are designed to improve the quality of life for many of VA employees. The most prominent recommendations include expanding employment opportunities for minorities, reducing discrimination against minorities, and improving the quality of the department's culture. Additionally, the OMA is currently implementing the named Oast program to assist veterans who are eligible to transition from military life to civilian life. A list of recommendations can be found here. This initiative could serve as a prelude to other significant changes that will be coming in the near future.
